Правовое регулирование телемедицины в России

Аннотация

Телемедицина является активно развивающейся формой оказания медицинской помощи, требующей сбалансированного правового регулирования. В связи с внедрением в российское законодательство экспериментальных правовых режимов (регулятивных песочниц), одним из направлений принятия которых является применение телемедицинских технологий, изучение указанного вопроса обретает дополнительную актуальность. Цель работы - анализ истории и современного состояния правового регулирования телемедицины в России, определение содержания рассматриваемого понятия, а также выявление проблем правового регулирования в данной сфере. Исследование основано на отечественных и иностранных научных источниках правового и медицинского характера, а также действующих и утративших силу нормативных правовых актах в области медицинских услуг и экспериментальных правовых режимов. Использованы формально-юридический, исторический, прогностический методы. В работе проанализированы «широкий» и «узкий» подходы к определению телемедицины, проведено разграничение телемедицины и смежных явлений, которые можно отнести к категории цифровизации здравоохранения. Выделены три этапа в истории развития правового регулирования телемедицины в России, проанализированы одновременно действующие базовое и экспериментальное правовое регулирование, а также выделены проблемы современного правового регулирования применения телемедицинских технологий.
