Традиционный казахский суд на страницах русской прессы конца XIX - начала XX в.

Аннотация

Анализируются характеристики традиционного суда у казахов на основе обычного права (суд биев, народный суд) в статьях российских современников, служившими в Степном крае или бывавшими там по служебным и иным делам, выходивших на страницах русской периодики и впоследствии включенных в «Туркестанский сборник» - уникальное собрание материалов, посвященных Русскому Туркестану и сопредельным странам и регионам, выходившему во второй половине XIX - начале XX в. Наряду с критикой практики казахского суда в современный им период эти авторы нередко весьма положительно оценивали суд у кочевников в прежние времена. Автор статьи намеревается выяснить, с какой целью чиновники идеализировали прошлое казахского суда: желали ли они расширить сферу его деятельности или, напротив, старались показать, что его трансформация в худшую сторону делает его бесполезным, и его следует заменить имперскими судебными инстанциями? Основными методами исследования являются формально-юридический, историко-правовой и сравнительно-правовой, контент-анализ. Автор приходит к выводу о том, что исследуемые материалы существенно дополняют наши представления о суде и процессе в Казахской степи рассматриваемого периода, базирующиеся на анализе историко-правовых памятников и официальной ведомственной информации.
