Эмоциональная сфера работника как объект правовой защиты

Аннотация
Проблематика защиты эмоциональной сферы работника в структуре личных неимущественных прав в науке трудового права пока не была подвергнута отдельному научному анализу, но сейчас она как никогда актуализируется. Это обусловлено в первую очередь тем, что в современном информационном обществе, в условиях сервисной экономики, когда меняется привычный уклад трудовых отношений, свойственный эпохе индустриального труда, на первый план снова выходит проблема определения границ власти работодателя над работником. Только теперь эти границы нужно устанавливать, учитывая не только физические, но и психоэмоциональные профессиональные риски. Предпринята попытка обоснования категории «эмоциональные» права работника как основного объекта защиты в структуре личных неимущественных прав работника. Анализ научной литературы, нормативного регулирования и правоприменительной практики по рассматриваемой проблематике показал, что всеобщее признание значимости личных неимущественных прав не обеспечивает повышение эффективности их правовой защиты, что в свою очередь связано с неопределенностью объекта защиты личных неимущественных трудовых прав. На этом основании предлагается конкретизировать и уточнить объект правовой защиты в конструкции личных неимущественных трудовых прав, к которому, с точки зрения автора, относится психоэмоциональная сфера работника. Такой подход позволяет более конструктивно определить механизм правовой защиты личных неимущественных трудовых прав.
