The Institution of Witness Immunity in Criminal Proceedings: The Main Problems and Prospects of Development

Abstract

Rapidly changing socio-economic conditions necessitate rethinking the institution of witness immunity in criminal proceedings and adjusting the norms of the criminal procedure legislation of its components. Its theoretical foundations should be subjected to scientific revision. Practical problems also remain relevant.

Purpose of the work: to analyze the nature of the institution of witness immunity, identify the main vectors of its subsequent development, identify the most acute problems and find ways to resolve them.

The systematization and study of the genesis of witness immunity in criminal proceedings made it possible to systematize the basic knowledge about it, which resulted in a new concept, the classification of persons who have the right not to testify. Recommendations are given on the introduction of certain amendments to the current criminal procedure law.
