Alimony Payment Agreement: Invalidity and Guarantees of Protection of the Alimony Recipient

Abstract

Alimony agreements are a sought-after legal instrument in law enforcement practice, however, cases of abuse of the right by the parties to this agreement have recently become more frequent. In this regard, the authors, based on doctrine, legislation and judicial practice, investigate the problems of invalidating alimony agreements, as well as guarantees for the protection of the rights of the alimony recipient. Scientific methods such as dialectics, analysis, synthesis, deduction, and the formal legal method have become the leading research approach.

The theoretical basis of the work was the scientific research of such scientists as V. V. Aleynikova, Yu. F. Bespalov, V. V. Bogdan, O. Yu. Ilyina, A. E. Larin, N. A. Semeryanova, A. S. Chursina, S. S. Shevchuk and others.

The novelty of the research lies in the formulation, justification and solution of tasks aimed at distinguishing an alimony agreement as an imaginary transaction and a transaction made in circumvention of the law. According to the authors, such a distinction is necessary to improve legal practice. The authors also propose to increase the guarantee of protection of the alimony recipient by increasing the amount of maintenance and insurance of the risk of liability of the alimony debtor under the alimony agreement.
