Regulators of Conflict of Interests in Judicial Activity: Theoretical and Practical Aspects

Abstract

Conflict of interests regulators form a complex system that includes legal and non-legal regulators. Based on the analysis of various approaches, it is proved that law is the main regulator of conflict of interests, which provides direct, targeted, permanent impact on the realization of legal interests aimed at preventing the occurrence and development of conflicts in legal relations. Non-legal regulators are compensatory regulators that have varying effects on the prevention and regulation of conflict of interests in legal relations. The author identifies individual and social regulators as non-legal regulators.

The influence of legal, individual and social regulation on the prevention of conflict of interests in judicial activity is determined, and the system-forming links between them are shown.
