The study used regulatory legal acts of the Russian Federation, the EU, Canada, the USA and China, scientific legal research and the legal press.</p> <p><bold>Results.</bold> The main results of the study showed that the current procedural legislation of the Russian Federation is not adapted to the use of artificial intelligence. Experiments with "weak artificial intelligence" in contract manufacturing (Belgorod and Amur regions) have confirmed the need for legislative changes. Key problems were identified: algorithmic bias (using the COMPAS system as an example), lack of legal entity status for artificial intelligence, risks of cyber-attacks, contradiction to the principles of competitiveness, internal persuasion and independence of judges.</p> <p><bold>Practical implications.</bold> Based on the analysis of foreign experience, recommendations are proposed: the consolidation of artificial intelligence as an auxiliary tool, the development of standards for the transparency of algorithms, the introduction of a risk-based approach, the training of judges and the creation of specialized legislation. The recommendations can also be used by the legislator when conducting research on the topic of the article. The importance of maintaining a balance between innovation and respect for the fundamental principles of law is emphasized.</p></abstract><trans-abstract xml:lang="ru"><p><bold>Обоснование.</bold> Статья посвящена анализу возможностей и ограничений интеграции искусственного интеллекта в судопроизводство Российской Федерации на примере процессуального законодательства.</p> <p><bold>Цель.</bold> Цель исследования заключается в оценке совместимости технологий искусственного интеллекта с отечественной правовой системой, выявлении правовых коллизий и разработке рекомендаций для адаптации законодательства.</p> <p><bold>Метод и методология проведения работы.</bold> В ходе исследования применялись метод анализа, формально-правовой, сравнительно-правовой и герменевтический подходы. В ходе исследования были использованы нормативные правовые акты Российской Федерации, ЕС, Канады США и КНР, научные юридические исследования и юридическая пресса.</p> <p><bold>Результаты.</bold> Основные результаты исследования показали, что действующее процессуальное законодательство Российской Федерации не адаптировано к использованию искусственного интеллекта. Эксперименты с «слабым искусственным интеллектом» в приказном производстве (Белгородской, Амурской области) подтвердили необходимость законодательных изменений. Выявлены ключевые проблемы: алгоритмическая предвзятость (на примере системы COMPAS), отсутствие правосубъектности искусственного интеллекта, риски кибератак, конфликт с принципами состязательности и внутреннего убеждения и независимости судьи.</p> <p><bold>Область применения результатов.</bold> На основе анализа иностранного опыта предложены рекомендации: закрепление искусственного интеллекта как вспомогательного инструмента, разработка стандартов прозрачности алгоритмов, внедрение риск-ориентированного подхода, обучение судей и создание специализированного законодательства. Рекомендации могут быть использованы законодателем и в исследованиях по теме статьи.
